Rocklands — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rocklands mobile application and any associated website (together, the "App"), operated by [Your Company / Legal Name] ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms and Changes

By creating an account, downloading, or using the Rocklands app in any way, you agree to these Terms of Service and our Privacy Policy. If you're using the app on behalf of a business or organisation, you confirm you have the authority to bind that organisation to these Terms.

We may update these Terms from time to time — for example, to reflect a new feature, a change in the law, or how we handle contributed content. If we make a material change, we'll let you know inside the app or by email before it takes effect. Continuing to use the app after a change takes effect means you accept the updated Terms.

2. Eligibility and Accounts

You must be at least 13 years old to create an account. If you're under 18, you confirm that a parent or guardian has given permission for you to use the app.

You're responsible for keeping your account credentials confidential and for everything that happens under your account. Let us know immediately if you suspect unauthorised access. Each account is for one person — please don't share logins.

3. Subscription, Trial, and Payment

Rocklands offers a free trial period, after which continued access requires a one-time purchase made through Apple's In-App Purchase system (or the equivalent on Android, where available).

All payments are processed by Apple or Google, and their own terms and refund policies apply — we don't process payments directly and can't issue refunds ourselves. Pricing may change for future purchasers; it won't change for a purchase you've already made.

4. Ownership of Content and Restricted Use — No Scraping or Redistribution

The GPS coordinates, first-ascent information, topo photographs, drawn route lines, and aerial/drone imagery in the app (together, the "Content") are the proprietary work of Rocklands and/or its contributors, built up over years of fieldwork. We grant you a personal, non-exclusive, non-transferable licence to view and use the Content within the app, for your own bouldering and climbing use.

You may not, by automated or manual means:

• Scrape, crawl, harvest, mirror, or systematically extract Content from the app or its underlying services;
• Copy, republish, redistribute, sell, sublicense, or create a derivative database, guidebook, website, or app from the Content;
• Circumvent, disable, or interfere with any technical measure we use to protect the Content, including authentication and access controls;
• Use the Content, or any part of it, to build a competing product or service;
• Reverse engineer, decompile, or attempt to extract the app's source code or underlying data structures, except where the law gives you an unwaivable right to do so.

We actively monitor for this kind of misuse and reserve the right to suspend or terminate any account involved in it, and to pursue any other remedy available to us under the law.

5. Content You Submit

If you contribute route information, photographs, or other material to Rocklands (for example, as an approved contributor), you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, adapt, publish, and distribute that content as part of the app and its promotion. You confirm that you own the rights to what you submit, or have permission to share it, and that it doesn't infringe anyone else's rights.

We may edit, decline, or remove submitted content at our discretion, including to correct errors or resolve disputes over accuracy or ownership.

6. Assumption of Risk — Climbing and Bouldering Are Dangerous

Bouldering and climbing are inherently dangerous activities that carry a real risk of serious injury or death, from falls, rockfall, weather, and other hazards. Rocklands is a reference tool, not a guarantee of safety.

Grades, descriptions, GPS coordinates, and condition notes in the app are provided by us and by contributors for reference only. They may be inaccurate, outdated, incomplete, or reflect one person's judgement rather than an objective standard — rock quality, weather, and access conditions can change without notice. GPS coordinates may be inaccurate by several metres.

By using the app, you acknowledge and accept these risks and take full responsibility for your own safety, judgement, equipment, and decisions. Rocklands is not a substitute for proper training, a spotter, appropriate pads, or good judgement in the field. Always verify conditions on the ground and never rely solely on the app to assess whether a route or area is safe.

7. Disclaimers and Limitation of Liability

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including that it will be accurate, uninterrupted, or error-free.

To the maximum extent permitted by law, Rocklands and its owners, contributors, and affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or damage arising from your use of, or inability to use, the app — including injury sustained while bouldering or climbing. Where liability cannot be excluded by law, it is limited to the amount you paid for the app in the 12 months before the claim.

8. Intellectual Property

The Rocklands name, logo, app design, and underlying software are our property or that of our licensors, protected by copyright, trademark, and other applicable laws. Nothing in these Terms transfers any of that ownership to you.

9. Prohibited Conduct

In addition to the restrictions in Section 4, you agree not to:

• Use the app for any unlawful purpose, or in a way that infringes anyone else's rights;
• Harass, impersonate, or misrepresent your identity to other users;
• Upload malicious code or attempt to disrupt the app's normal operation;
• Use the app or its Content to suggest you have a right to access private land — bouldering areas may cross private property, and it remains your responsibility to know and respect local access agreements, landowner permissions, and seasonal closures.

10. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you've violated these Terms — particularly the restrictions on scraping and redistribution in Section 4. You may stop using the app and delete your account at any time via the app's settings or by contacting us.

11. Privacy

Our Privacy Policy explains what personal information we collect — such as your account details and any GPS tracks you choose to record — and how we use it, in line with South Africa's Protection of Personal Information Act (POPIA).

12. Governing Law and Disputes

These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the app will be subject to the exclusive jurisdiction of the South African courts.
